Het spook dat onder de naam Covid-19 (Corona) rondwaart leidt tot allerhande heftige discussies. In de discussie over de vraag of (en in welke gevallen) verplicht een mondkapje moet worden gedragen, wordt veelal gerefereerd aan het begrip ‘vrijheid’. Het verplicht moeten dragen van een mondkapje wordt als vrijheidsberoving gezien, althans minimaal als een inperking van ‘onze’ (fundamentele) vrijheid. Daar wordt dan geregeld tegen ingebracht dat bijvoorbeeld het verplicht moeten dragen van een helm op een motorfiets of een gordel in een auto ook een beperking van die vrijheid inhoudt. RECHTSPRAAK WET HOMOLOGATIE ONDERHANDS AKKOORD
WHOA in Nederland op 1 januari 2021 in werking getreden
In Nederland is op 1 januari 2021 de Wet Homologatie Onderhands Akkoord (WHOA) in werking getreden. De wet maakt het mogelijk om buiten faillissement of surseance tot een herstructurering te komen van de schulden van levensvatbare bedrijven dan wel een gecontroleerde afwikkeling van niet-levensvatbare bedrijven. In dat laatste geval wordt met een zogeheten dwangakkoord in de regel een hogere opbrengst voor de schuldeisers gerealiseerd dan wanneer de weg van een kostbaar faillissement zou worden gevolgd. Spreek en schrijf begrijpelijk
Taal is hét instrument van een jurist. Een advocaat gebruikt taal om afspraken vast te leggen, adviezen uit te brengen, processtukken te schrijven, sommatiebrieven te sturen, een pleidooi te houden of gesprekken met cliënten of wederpartijen te voeren, declaraties te versturen, kortom: om zijn vak uit te oefenen. Voor velen is wat advocaten opschrijven maar moeilijk te begrijpen. Dat komt deels door de wijze waarop veel advocaten hun vak hebben geleerd, maar ook doordat wet- en regelgeving nogal formeel en weinig helder zijn geformuleerd, terwijl gebruik wordt gemaakt van tal van specifiek omschreven begrippen.

PRELIMINARY RELIEF PROCEEDINGS IN THE DUTCH CARIBBEAN
A.K.A. Summary Proceedings or Interlocutory Proceedings
The procedure for provisional measures in summary proceedings (kort geding), or preliminary relief proceedings or interlocutory proceedings, is to request an interim injunction before the court. Such proceedings, under the laws of Aruba, Bonaire, Curaçao, St. Maarten, St. Eustatius and Saba, are aimed at obtaining temporary instructions from the court, not at receiving a final decision in the case.
Provisional remedies may be permitted in preliminary relief proceedings in civil cases if the claim meets the following three conditions: (i) there is an urgent interest at stake; (ii) the interests of both parties needs …

Rights of foreign trustees are recognized
With respect to the question whether a Trustee in bankruptcy appointed in a foreign country can exercise his powers in Curaçao, there is specific case-law available. In a Curaçao lawsuit the question was raised whether the (foreign) Trustees in the bankruptcy of a natural person residing in South Africa are authorized to perform acts in relation to a legal entity (in this case a private foundation) in Curaçao, which legal entity was in fact controlled by him.

New ordinances and rules to be introduced in 2021
In Curacao and St. Maarten major changes are in the pipeline when it comes to regulatory legislation. In July 2020, the Central Bank (CBCS) launched a consultation round on the draft of three national ordinances and a regulation containing generally binding rules. The first draft concerns the supervision of payment service providers. In order to increase confidence in digital payment services, the draft provides for licensing requirements, substantive rules, oversight of systems, and enforcement and supervision by the CBCS. Kralendijk – Adely Susana-Jansen is per 1 november 2020 benoemd tot tijdelijke bestuurder van Bonaire Holding Maatschappij N.V.
De Raad van Commissarissen van Bonaire Holding Maatschappij N.V. heeft Adely Susana-Jansen Bsc, MBA benoemd tot tijdelijke bestuurder. De benoeming gaat in op 1 november 2020. Zij was tot voor kort werkzaam bij Bopec als financial controller en superintendent finance. Zij was eerder werkzaam bij het Departement Financiën van Bonaire als waarnemend hoofd van de afdeling financiële administratie en als beleidsadviseur.
Na het vertrek van de vorige tijdelijke bestuurder per eind mei, heeft de Raad van Commissarissen tijdelijk de bestuurstaak waargenomen. …
