“In what is by far the largest investor settlement ever under the Dutch collective settlement procedures, several shareholder foundations have reached an agreement to settle the Fortis shareholder claims for a total of €1.204 billion ($1.3 billion).
The shareholder foundations’ settlement with Ageas, as Fortis is now known, relates to Fortis’s ill-fated October 2007 participation in the ABN AMRO acquisition just before the global financial crisis. ARREST HOF AMSTERDAM IN FORTIS-ZAAK
Beleggers misleidend en onvolledig geïnformeerd
Door het Gerechtshof te Amsterdam is op 29 juli 2014 arrest gewezen in de zaak die door onder andere de (collectieve belangen) stichting Fortis Effect was aangespannen tegen de Staat der Nederlanden en Ageas N.V. (voorheen Fortis). De uitspraak is hier integraal te lezen (ECLI:NL:GHAMS:2014:3005).

AANSPRAKELIJKHEID OVERHEID ALS AANDEELHOUDER
Symposium 26 februari 2010
Op vrijdag 26 februari 2010 vond het symposium ‘Overheid en aansprakelijkheid‘ plaats. Het symposium was georganiseerd door het Centrum voor Postacademisch Juridisch Onderwijs van de Radboud Universiteit Nijmegen in samenwerking met de Universiteit van de Nederlandse Antillen.
Ik heb daar een verhaal mogen houden. De andere sprekers waren prof. mr P. van Schilfgaarde (emeritus hoogleraar Ondernemingsrecht Universiteit Utrecht en Universiteit Groningen, advocaat Hoge Raad der Nederlanden), mr. B.M. Mezas (General Counsel van de Bank van de Nederlandse Antillen) en prof.mr. S.C.J.J. Kortmann (Rector magnificus, tevens hoogleraar Burgerlijk recht, Radboud Universiteit Nijmegen).

DUTCH GOVERNMENT INJECTS $13 BILLION IN ING GROUP
Restoring confidence is key
Recently, the Dutch government acquired all shares in the capital of the Dutch subsidiary of Fortis, i.e. Fortis Bank Nederland, including ABN AMRO Bank.
Furthermore, the Dutch government has set aside $27.5 billion of capital to protect the financial institutions of the Netherlands. Although there are many banks that have enough capital to get them through this period of market turmoil (a ‘credit tsunami’, according to Alan Greenspan), many of these financial institutions are not in a position to lend money at the levels that are necessary to support the Netherlands …
